Terms, Privacy, Shipping, Returns & Exchanges

1. Scope and Acceptance

This website is operated by Pottery By Alaa. These terms apply to all use of the website and business services, including browsing, contact inquiries, orders, payments, shipping, pickup, cancellations, returns, and exchanges.

You may use the website only if you are legally capable of entering into a binding transaction. Anyone placing an order on behalf of another person or business represents that they are authorized to do so.

If any provision of these terms conflicts with mandatory law applicable to the transaction, the mandatory law will prevail only to that extent and the remaining provisions will remain in force.

2. Product Nature and Descriptions

All products are handmade. Reasonable variations in color, size, shape, glaze, weight, and texture are expected and form part of each item's character, not a defect.

Photos, videos, measurements, colors, descriptions, and examples on the website are provided for illustration and general information only. Differences may occur because of screens, lighting, camera angles, raw materials, and firing processes.

We may update product descriptions, prices, availability, images, and features at any time, provided that the price and terms approved for a specific order will apply to that order, subject to our rights under applicable law in the case of an obvious error.

3. Availability, Pricing, and Order Approval

Listing a product on the website does not guarantee immediate availability. Inventory gaps, stock errors, pricing mistakes, technical issues, or incomplete information may occur.

An order is considered accepted only after it is received in our systems and payment is approved by the payment processor, payment app, or bank. Until then, we may decline or delay acceptance of the order.

Where there is a reasonable suspicion of fraud, abuse, false information, an attempt to bypass procedures, or an obvious pricing or product error, we may delay, verify, correct, or cancel the order and issue a refund of any amount paid, subject to applicable law.

4. Made-to-Order Production and Timelines

Products that are in stock are usually dispatched within a reasonable time, subject to business days, workload, and the time the order is placed.

Products that are not in stock, or that are specially made for a customer, may require extended production time depending on order quantity, studio workload, production issues, raw material shortages, emergency situations (including war), or other circumstances beyond our control.

Any production, delivery, or collection date stated on the website, in a message, by phone, or in correspondence is an estimate only and is not a guaranteed deadline unless we expressly confirm otherwise in writing.

5. Shipping, Delivery, and Force Majeure

Delivery times depend on the shipping carrier, delivery area, and recipient availability, and are estimates only.

Customers are responsible for providing accurate delivery details and being available to receive the shipment. Returned parcels caused by an incorrect address, failed delivery, refusal, or failure to collect may require additional shipping charges and reasonable handling fees, subject to law.

We are not responsible for delays, disruption, partial loss, failed delivery, or inability to provide service caused by events beyond our reasonable control, including force majeure, war, security events, strikes, closures, extreme weather, logistics failures, unusual carrier volume, epidemics, system outages, communication infrastructure failures, or actions of authorities.

6. Studio Pickup and Storage

Self-pickup is available only by prior coordination and from the location communicated by the business.

Once you are informed that the order is ready, it must be collected within a reasonable time. If an order remains uncollected for an extended period, we may send further notice, charge reasonable storage costs, or treat the order as incomplete after reasonable warning.

Upon release of the product to the customer or the customer's representative during pickup, responsibility for handling, storage, and transportation passes to the customer.

7. Cancellations, Returns, and Exchanges

Cancellation, refund, and exchange rights are governed by applicable consumer protection laws, relevant regulations, and any mandatory law applying to distance sales or the product category.

A cancellation or return request may be submitted within 14 days from delivery, provided that the product has not been used, damaged, or altered and is returned in proper, clean, complete condition and, where possible, in its original packaging.

Products specially made to personal specifications, customized items, engraved items, custom sets are non-cancellable and non-returnable unless mandatory law requires otherwise.

Exchanges are subject to stock availability, product condition, prior coordination, and payment of any price difference. Return or exchange shipping costs are the customer's responsibility unless the item arrived damaged or due to our error.

8. Damaged, Broken, or Incorrect Items

If an item arrives broken, materially damaged, or materially different from the approved order, contact us within 48 hours of delivery and provide clear photos of the item, packaging, protective materials, and shipping label. Please do not continue using the item until the matter is reviewed.

We may inspect each claim, request further information, examine the product, or require its return as a condition of handling the claim. Subject to law and the circumstances, the remedy may be repair, replacement, store credit, or refund.

If notice is not given within a reasonable time or the customer does not cooperate with the review, it may be difficult to verify shipping damage or mismatch, and we may reject the claim.

9. Permitted Use, Product Responsibility, and Liability Limit

Products must be used in accordance with all care, maintenance, and safety instructions. Avoid thermal shock, dropping, unsuitable heating, negligent handling, commercial use inconsistent with the product purpose, or modification of the product.

We are not liable for personal injury, property damage, breakage, wear, lost profits, distress, indirect damages, special damages, consequential damages, or losses caused by misuse, natural wear, improper care, third parties, or circumstances outside our control.

To the maximum extent permitted by law, our total liability in connection with any order, product, or use of the website is limited to the amount actually paid for the specific product giving rise to the claim.

10. Privacy, Data Security, and Marketing

We may collect and process information you provide or that is generated through use of the website, such as name, contact details, address, order details, customer-service communications, technical usage data, and information needed to operate the transaction, website, and services.

Information may be used for order processing, customer support, shipping, payments, fraud prevention, bookkeeping, website operation, information security, service improvement, and compliance with legal obligations. Information may be shared with relevant service providers such as payment processors, shipping providers, hosting and cloud providers, mailing services, technical support providers, and professional advisers, but only to the extent needed for their role.

We apply reasonable security measures customary for a business of this type, but no system is fully immune from intrusion, unauthorized access, disclosure, data loss, cyber attacks, malware, server failures, software bugs, third-party failures, infrastructure outages, force majeure events, or other events beyond our reasonable control. Accordingly, and subject to applicable law, we are not responsible for damage, loss, leakage, exposure, or harm caused by such events when they are outside our reasonable control.

Marketing messages are sent only where consent or another lawful basis exists, and you may opt out at any time in accordance with applicable law.

11. Intellectual Property and Prohibited Activity

All intellectual property rights in the website, including text, images, videos, designs, files, logos, branding, and trademarks, belong to the business or to rights holders who permitted their use.

You may not copy, reproduce, distribute, publish, translate, scrape, commercially exploit, publicly display, or create derivative works from website content without prior written consent.

You may not use the website in a misleading, abusive, unlawful, automated, infringing, or harmful manner, including bypassing security measures, interfering with the website, collecting data without authorization, or harming the business or its customers. We may block such activity and pursue any remedy available under law.

12. Pottery Workshop Terms

These workshop terms apply to participation in pottery workshops, in addition to all terms governing orders, payments, and other business services.

  • A workshop booking request is subject to availability and becomes final only after explicit confirmation by the studio.
  • Participants must arrive at the scheduled start time. Late arrival does not extend the session and may result in lost activity time without refund.
  • Cancellation within the last 48 hours before the workshop is subject to a 20% cancellation fee. No-shows may be treated as late cancellations.
  • Rescheduling requests are handled at the business's discretion and subject to availability, and are not guaranteed in advance.
  • Participants are responsible for safe and proper use of all tools, materials, and equipment according to instructor guidance. Damage caused by misuse may require compensation.
  • Workshop pieces require drying and kiln firing, and in some formats an additional firing after painting and glazing. Completion timing is an estimate only and may vary due to workload, production issues, material shortages, emergency situations, or force majeure.
  • Because items are handmade, natural variations in color, form, and finish may occur. In rare cases, cracks, breakage, or glaze changes may occur during firing despite professional care.
  • The studio may photograph workshop activity and finished pieces for documentation and marketing. Participants who do not wish to appear must notify the studio at the beginning of the session.

13. Gift Card Terms

These terms apply to the purchase, issuance, and redemption of gift cards, in addition to all other terms that apply to orders, payments, and business services.

  • A gift card may be redeemed for up to 6 months from its issue date. After that date, the gift card expires.
  • An expired gift card cannot be redeemed, extended, exchanged, or refunded.
  • Gift card redemption is subject to the specific gift-card details, availability, advance coordination, and the relevant workshop/service policy.
  • Gift cards are personal, are not redeemable for cash, and no cash balance or credit will be provided beyond the card balance.
  • In case of loss, theft, misuse, or incorrect sharing of gift-card details, responsibility remains with the purchaser/holder, subject to applicable law.

14. Governing Law, Jurisdiction, and Policy Updates

These terms and any use of the website are governed by the laws of the State of Israel. Jurisdiction will be determined in accordance with applicable law and the competent courts.

We may update, amend, remove, or add to these terms from time to time. The binding version is the version published on the website at the time of use or at the time the order is placed, as applicable.

If any provision is held unenforceable, void, or unlawful, the remaining provisions will continue in effect to the fullest extent possible.
